By creating an account or using Subseven (“the App”), you agree to be bound by these Terms of Use, the Privacy Policy, and the Medical Disclaimer (collectively, the “Agreement”). If you do not agree to this Agreement, do not use Subseven.
Subseven is a lifestyle and data-tracking application designed for people living with diabetes and others who want to understand patterns in their health.
The App allows you to log meals, activities, symptoms, and notes, and to interact with an AI companion that surfaces patterns, summaries, and insights.
Subseven may process health-related data that you choose to log manually or connect through authorized integrations. These integrations may include Apple HealthKit, Dexcom via the Dexcom Developer program, Whoop via the Whoop Developer program, and other supported sources accessed directly or through integration partners such as Rook (tryrook.io).
Some data may be processed on your device, while other data may be securely transmitted to and processed on our servers to enable analytics, summaries, and pattern detection. Any such data is handled in accordance with our Privacy Policy.
Any insights, summaries, or outputs generated by Subseven, including AI-generated responses, are provided for informational and educational purposes only.
Important: Subseven is not a medical device and does not provide medical advice, diagnosis, or treatment. The App must not be used as a substitute for professional healthcare.
You must be at least 18 years old to use the App, or have parental or legal guardian consent if you are between the ages of 13 and 17.
The App is not intended for children under the age of 13, and we do not knowingly permit use by or collect information from children under 13.
You must provide accurate, complete, and current information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to notify us immediately if you suspect unauthorized access to or use of your account.
Subseven is offered as a paid subscription through the applicable app marketplace in-app purchase system.
On iOS, subscriptions are handled through Apple’s in-app purchase system. On Android (when available), subscriptions will be handled through the applicable Android marketplace provider.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Cancellation must be completed through your marketplace account settings, such as your Apple ID or Google account.
Refunds are governed solely by the policies of the marketplace provider. We do not process refunds directly.
We may change subscription fees with advance notice. Continued use of the App after a price change constitutes acceptance of the updated pricing.
You agree not to:
Subseven integrates with third-party services and APIs, which may include Apple HealthKit, Dexcom, Whoop, and data providers accessed through Rook (tryrook.io).
Your use of third-party services is subject to their respective terms, policies, and permission settings.
We do not control and are not responsible for the accuracy, availability, reliability, or interruptions of third-party services or data sources.
You acknowledge that third-party services may change, suspend, or discontinue access at any time, which may affect App functionality.
Subseven is not responsible for errors, delays, or data issues originating from third-party services.
You may terminate your account at any time.
Deleting the App does not cancel your subscription. You must cancel through the applicable marketplace provider.
We may suspend or terminate your access to the App if you violate this Agreement, misuse the App, or engage in unlawful behavior.
Fees are non-refundable except as required by marketplace provider policies.
Certain provisions of this Agreement, including disclaimers, limitations of liability, and indemnification, survive termination.
The App is provided on an “AS IS” and “AS AVAILABLE” basis.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not guarantee that the App or its outputs will be accurate, complete, uninterrupted, error-free, or produce any specific health outcome.
To the maximum extent permitted by law:
Subseven shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including health events or adverse outcomes, even if foreseeable.
Our total liability for any claim arising out of or relating to the App shall not exceed the subscription fees you paid during the three (3) months immediately preceding the event giving rise to the claim.
Your sole and exclusive remedy is to stop using the App.
You agree to indemnify and hold harmless Subseven, its officers, employees, contractors, and affiliates from and against any claims, damages, losses, or expenses arising out of or related to:
This Agreement is governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict of law principles.
Any dispute arising out of or relating to this Agreement shall be resolved exclusively in the state or federal courts located in Pennsylvania.
